INTRODUCTION AND SCOPE
This Privacy Policy (the Policy) explains how personal data is collected, used and processed in accordance with applicable data protection regulations, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (hereinafter, the GDPR) by Luxembourg Art Week S.A. a public limited company, registered with the Luxembourg Business Register under number B205876, with registered office at 4, rue Wiltheim L-2733 Luxembourg, Luxembourg (hereinafter, we, us, or our). We are responsible for the processing of the personal data related to the Fair and Website, as defined below.
The Policy is addressed to all visitors, participants and users (hereinafter you or your) of:
· Luxembourg Art Week’s website available at: www.luxembourgartweek.lu (hereinafter, the Website);
· the annual fair organized by Luxembourg Art Week (the Fair);
· the dedicated ticketing webshop accessible through the Website; and
· the dedicated invitation platform accessible to art galleries (hereinafter, the Exhibitors) and our partners (hereinafter, the Partners) with a personal link and dedicated account.
1. WHICH PERSONAL DATA DO WE PROCESS
Personal data we process includes (hereinafter, the Personal Data):
For the use of the Website:
· IP address
For the use of the Website, if you have a VIP access:
· First & last names (and of your +1, if you have one)
· E-mail and phone number
· IP address
For the use of the Website, if you have an Exhibitor access:
· First & last names,
· E-mail
· IP address
For the ticketing webshop:
· First & last names
· E-mail
· City and country of residence
· Age group
· Banking details for payment and invoicing purposes
For the invitations’ platform, we process your:
· First & last name
· E-mail
· City and country of residence
· Age group
During the Fair:
· Photos and/or videos (if you are recognizable on a group photo and/or video and on which you accepted appear).
2. WHY DO WE PROCESS YOUR PERSONAL DATA
We will process your Personal Data on the legal basis below for the following purposes:
· to perform or enter into a contract with you (e.g. for the application process, for the use of ticketing webshop, for the invitation process, including account creation, sending and managing of invitations, VIP account administration management)
· for our legitimate interests, including:
o to establish efficiently the attendance list (e.g. relating to the VIP programme);
o to ensure the security at the Fair by ensuring an efficient identification and verification at the entrance of the Fair
o to respond and to manage your requests
o to better understand your needs and improve the quality, security and experience of our Website and communications to you
o for statistical purposes (in relation to the invitations platform management).
For any other purposes, we will specifically seek your prior consent, unless we are compelled by the law to do so.
3. WHO ARE RECIPIENTS OF PERSONAL DATA
Your Personal Data will not be shared with any third parties without your prior knowledge and/or consent (when such consent is legally required).
To achieve the purposes described above, we may share some of your Personal Data with:
· third party platforms or services providers we may use for the ticketing webshop, invitation platform, our newsletter, application forms or to collect information about the use of the Website, your interests and preferences;
· government authorities, and to other third parties when compelled to do so by government authorities or otherwise as required or permitted by law, including but not limited to in response to court orders.
4. HOW DO WE PROTECT YOUR PERSONAL DATA
We use reasonable security methods to prevent your personal data from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed. However, because no security system is impenetrable and internet communications are insecure, we cannot guarantee the security of your data on our servers or any data leak from third parties. In case of any suspected Personal Data breach, we will notify you and any applicable regulator when we are legally required to do so.
The Website includes links to third-party websites and social networks (such as Facebook, Youtube, Instagram, Linkedin etc.), plug-ins and applications whose privacy practices may differ from of ours. If personal information is submitted to any of these third-party sites, your information is governed by the privacy policies of those sites and no longer governed by this Policy. We encourage you to carefully read the privacy policy of any websites you visit.
Where your Personal Data is transferred to third-party providers (e.g. used for our newsletter), which are located in a country outside the European Economic Area (hereinafter, the EEA), which does not ensure a level of protection equivalent to that in the EEA, an adequate level of protection in ensured by appropriate safeguards such as standard contractual clauses and other legal safeguards in accordance with the GDPR. You can contact us if you would like to receive a copy of the safeguards in place to secure data transfers outside the EEA.
5. HOW LONG DO WE STORE YOUR PERSONAL DATA
In general, Personal Data processed by us is retained as long as necessary to achieve the result targeted. Retention periods differ depending on the processing purpose.
At the end of the Fair, we will retain only your Personal Data regarding city, country, and age group for statistical purposes. Such data will be kept separate from your personal identifiers, meaning we could never identify you solely on this basis.
You can easily unsubscribe from our newsletter by clicking on the “unsubscribe” link at the bottom of each newsletter at any time.
6. WHAT ARE YOUR RIGHTS
Under the GDPR, you have a right of information, access, objection, erasure, portability, rectification of your Personal Data, unless we can demonstrate a compelling legitimate reason for retaining it.
You also have the right to withdraw your consent at any time without any justification (e.g. unsubscribe from our newsletter delete your VIP account on the Website).
Please bear in mind that if we feel that your request is vague, we may discuss it with you to better understand the reason. We also may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.
We also reserve the right to charge a reasonable administrative fee for any manifestly unfounded or excessive requests concerning access to your Personal Data, and for any additional copies of the Personal Data requested.
You have also the right to lodge a complaint with your local data protection authority about any of our activities in relation to this Policy, which you may deem are not compliant with the GDPR.
